Overview | The Higher Education Support Act (HESA) is the current legislative basis for the Commonwealth to provide financial support for higher education through grants and other payments made largely to higher education providers; and through financial assistance to students (usually in the form of loans). Measures funded under HESA include: 1. the Commonwealth Grant Scheme (CGS) - provides funding to the University (as a higher education provider) to help subsidise students’ tuition costs. 2. the Higher Education Loan Program (HELP) arrangements - provides income contingent loans to help students meet their study costs. 3. Commonwealth Scholarships - assists Aboriginal and Torres Strait Islander students with costs associated with higher education. In addition, HESA makes other grants available to higher education providers for a variety of purposes, including: 1. the Disability Support Program (DSP) - provides funding to eligible higher education providers to improve access for students with disabilities. 2. the Indigenous Support Program - provides grants to higher education providers to assist them to meet the needs of their Aboriginal and Torres Strait Islander students. 3. the Structural Adjustment Fund - provided funding to assist universities to operate more competitively in the demand driven funding environment. 4. the Higher Education Participation and Partnership Program (HEPPP) - supported universities efforts to increase participation of people who are from low socio-economic status backgrounds to attend university. From 1 January 2015 replaced by the Higher Education Participation Program (HEPP). 5. grants to a limited number of National Institutes to support ongoing operations; 6. the Promotion of Excellence in Learning and Teaching in Higher Education - provides funding for initiatives to improve and recognise teaching and learning. 7. the Superannuation Program provides supplementary funding to eligible higher education providers to cover certain superannuation expenses for staff. 8. the Australian Maths and Science Partnerships Program (AMSPP) - seeks to improve student engagement in maths and science courses at university and schools, through innovative partnerships between universities, schools, and other relevant organisations. The University is required to give to the Minister statistical and other information the Minister requests regarding the provision of higher education and compliance with this legislation. |

Description | Under Division 38 - Grants under this Part are also dealt with in the Indigenous Student Assistance Grants Guidelines https://www.legislation.gov.au/Details/F2018C00933. The provisions of this Part indicate when a particular matter is or may be dealt with in the Guidelines. Eligibility; (1) A *Table A provider or *Table B provider is, subject to subsection (3), eligible for grants under this Part, in respect of the year 2017 or a later year, for the following purposes: (a) assisting Indigenous students to undertake higher education; (b) increasing the number of Indigenous students enrolling in, progressing in and completing courses leading to *higher education awards. (2) Without limiting subsection (1), the purposes mentioned in that subsection may be achieved through the following means: (a) providing scholarships; (b) providing academic support, including supplementary tuition; (c) providing pastoral care; (d) implementing strategies to: (i) accelerate improvements to Indigenous student outcomes in higher education; or (ii) foster culturally�'safe learning environments in higher education. (3) If the Indigenous Student Assistance Grants Guidelines: (a) provide for a grant; and (b) specify extra conditions of eligibility to receive the grant; then a *Table A provider or *Table B provider is not eligible for the grant unless the provider complies with those extra conditions. |

Description | Under s41-10(1) of the Act the University is eligble to apply for grants to promote equal opportunity in higher education. In accordance with s41-15(1) of the Act the Other Grants Guidelines (Education) 2012 specifies the Indigenous Support Program is a program under which grants are to be paid. The Indigenous Support Program (ISP) provides funding to eligible higher education providers and aims to assist eligible higher education providers to meet the special needs of Indigenous Australian students and to advance the goals of the National Aboriginal and Torres Strait Islander Education Policy. The Indigenous Education Statement is used to determine University’s eligibility for Indigenous Support Programme (ISP) funding. To be eligible to receive Indigenous Support Program grants in any one year, the University must meet all of the following criteria: (a) implementation of strategies for improving access, participation, retention and success of Indigenous Australian students; (b) demonstrated increased participation of Indigenous people in the provider�Ys decision-making processes; and (c) the provider has an Indigenous employment strategy. and the following reporting obligations: (a) details of expenditure of ISP funds ( to be included in the Indigenous Education Statement), including: (i) the proportion of ISP funding provided to the Indigenous Education Support Centre; (ii) the proportion of ISP funding provided to individual facilities within the university; and (iii) the proportion of ISP funding allocated to staff salaries, on-costs andoperating costs; and (b written request to carrying forward unspent ISP funds; and (c) details of all additional funding provided to the recipient to support the recipient�Ys Indigenous activities (for example, in kind support; financial support); including funding provided by the higher education provider and all additional funding provided by sources other than the higher education provider. [This report excludes funding received under any other Department of Industry, Innovation, Science, Research and Tertiary Education Indigenous specific funding programs already reported on separately (for example the Indigenous Tutorial Assistance Scheme or the Away-From-Base Program]. |

Description | 19-60 1. A higher education provider must comply with the Australian Privacy Principles in respect of personal information. 2. A higher education provider must have a procedure under which a student enrolled with the provider may apply to the provider for, and receive, a copy of personal information that the provider holds in relation to that student. 3.The provider must comply with the requirements of the Higher Education Provider Guidelines relating to personal information in relation to students; and the procedure referred to in subsection 2. |

Description | s19-35 Benefits and opportunities must be available equally to all students. A higher education provider that receives grants for higher education assistance: 1. in respect of a student, or a class of students, must ensure that the benefits of, and the opportunities created by, the assistance are made equally available to all such students, or students in such class, in respect of whom that assistance is payable. 2. must have open, fair and transparent procedures that, in the provider’s reasonable view, are based on merit for making decisions about the selection of students who are to benefit from the grant, allocation or payment. |

Description | Under s19-37 a higher education provider must not: (a) require a person to be or to become a member of an organisation of students, or of students and other persons; or (b) require a person enrolled with, or seeking to enrol with, the provider to pay to the provider or any other entity an amount: i.in respect of an organisation of students, or of students and other persons;unless the person has chosen to be or to become a member of the organisation. ii.for the provision to students of an amenity, facility or service that is not of an academic nature, unless the person has chosen to use the amenity, facility or service (does not apply to a student services and amenities fee that the higher education provider requires the person to pay). |

Description | s19-10 1) A higher education provider must give to the Minister a financial statement for each annual financial reporting period for the provider in which: (a) the provider receives assistance under this Chapter; or (b) a student of the provider receives assistance under Chapter 3. (2) The statement: (a) must be in the form approved by the Minister; and (b) must be provided together with a report on the statement by an independent *qualified auditor; and (c) must be provided within 6 months after the end of the *annual financial reporting period for which the statement was given. |

There is a collective interest in transparency regarding the use of these funds and the allocation of resources across the various activities that universities engage in. The way in which this funding is provided, in terms of the specific teaching and research activities it is intended to support, significantly influences the behaviour of universities. The Australian Department of Education, Skills and Employment (the Department) established the Transparency in Higher Education Expenditure exercise, commissioning Deloitte Access Economics to undertake this collection. |
