Overview This Act establishes a national scheme to improve the energy efficiency of commercial office buildings by requiring energy efficiency information to be disclosed when they are offered for sale, lease, or sublease. As a constitutional corporation that may own, lease, and sublease a portfolio of buildings, which contain office space exceeding the prescribed threshold (currently 1,000 square metres), the University has obligations under this Act. These obligations are triggered whenever the University seeks to sell a building or lease/sublease office space that falls within the Act's scope.
For example:
s 11 No sale, lease or sublease without a building energy efficiency certificate - Offering to sell, lease, or sublease a disclosure affected building or area without a current, registered BEEC. Body Corporate: 1,000 penalty units. For a continuing contravention, an additional 100 penalty units per day. The instance of non-disclosure may be recorded on the public Energy Efficiency Non-disclosure Register (s 65). Liability attaches to the University as the constitutional corporation.
s 19 Offences relating to information obtained or generated in applying for a certificate - A University employee or agent copies, uses, or discloses information obtained for the purpose of a BEEC for an unauthorised purpose. Imprisonment for 2 years. The offence applies to the "person" who misuses the information. The University could be held vicariously liable under general principles of corporate criminal responsibility.
